You Are Innocent Until Proven Guilty, Even If The Charges Are For Sex Crimes

If you get accused of a crime in the United States, you have the right to the presumption of innocence and to due process of law. This is true regardless of your immigration status, the crime for which you are facing accusations, and the apparent strength of the prosecution’s evidence against you. Some criminal charges attract more of a media circus than others. People who have nothing better to do in life spend time on social media obsessing over how this person or that person might be doing something that leads to something that leads to something else that leads to sexual abuse of children. Therefore, when there is enough evidence that a person intended or attempted to sexually abuse a minor that the person got arrested, that person is often guilty in the court of public opinion before he or she even enters a plea. The state cannot impose a sentence, however, or require you to register as a sex offender unless and unless you plead guilty or receive a conviction at trial. If you are facing criminal charges for a sex-related offense, contact a Tampa sex crimes lawyer.
Man Faces Charges for Internet Sex Crimes Against a Minor After Police Intercept Communications
Yosvany Fernandez Gonzalez, 37, is facing criminal charges for offenses including possession of child exploitative content, use of electronic communications devices to harm a child, and traveling to meet a minor, among others. He met a teen girl in the lobby of her building in Miami, and they exchanged phone numbers. She truthfully told him that she was 12 years old, and he falsely told her that he was 27. Over the next few months, they exchanged messages and sexually suggestive photos. One day, they agreed to meet in the laundry room of the girl’s building, but the mother refused to let the girl leave the apartment. She looked through her daughter’s phone, found the messages, and called the police.
The police took the phone and continued exchanging messages with Fernandez Gonzalez, pretending to be the girl. Eventually, Fernandez Gonzalez told his chat partner that he would meet her at Target on Wednesday afternoon. When he arrived at the meetup point, the girl was not there, but several police officers were, and they arrested him. Fernandez Gonzalez posted $55,000 in bail, and while his case is pending, he is on house arrest and required to wear a GPS ankle monitor. He is not allowed to contact the girl or go near her building.
Fernandez Gonzalez sought the representation of a public defender in his case, as all defendants have the right to do. The chances of a successful outcome are better, however, if you hire a criminal defense lawyer to represent you.
